Terms of service
1. Who we are
The eFakturi.net service is provided by to be confirmed. Contact us at support@efakturi.net.
These Terms govern your use of the site and the service. By using the service you agree to them. If you do not agree, do not use the service.
2. What the service is
eFakturi.net is a tool for creating invoices and related documents from data you enter. It computes totals and VAT and fills in the mandatory fields under Art. 114 of the Bulgarian VAT Act.
The service is not accounting software, is not a fiscal sales-management system under Ordinance N-18, and is not accounting, tax or legal advice. We do not undertake to monitor changes in legislation on your behalf.
3. Accounts and access
Some features require an account. Because sign-in works through a link sent to your email address, you are responsible for the security of that mailbox. Tell us immediately if you suspect unauthorised access.
The service is intended for users aged 18 or over, acting in the course of their trade or profession or for their own purposes.
4. Your content and responsibility
You remain the owner of the data and documents you create. You are responsible for their accuracy - party details, descriptions, quantities, prices, VAT treatment, the legal basis when VAT is not charged, and the chronology of your numbering.
We take due care that calculations and mandatory fields are correct, but checking any particular document before you issue it remains yours. An issued document is a tax document - the system will not let it be altered, and corrections are made by credit or debit note.
Do not use the service for unlawful purposes, to create documents with false content, to circumvent usage limits, to place automated load on it, or in any way that threatens its security or availability.
5. Keeping your records
We are a document generator, not a statutory archive. Saved invoices are available in your account, but the obligation to retain accounting records for the statutory periods is yours. Export is available at any time and we recommend using it regularly.
6. Plans, prices and payment
Current plans and prices are published on the home page. Prices are in euro. Payments are processed by Stripe - we neither receive nor store your card details.
Subscriptions renew automatically for the same period until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current paid period and does not refund it, unless the law provides otherwise.
If prices change we will tell you by email in advance. The change applies from your next renewal - if you do not accept it, you may cancel before that renewal begins.
7. Right of withdrawal (consumers)
If you use the service as a consumer within the meaning of the Bulgarian Consumer Protection Act, you have 14 days to withdraw from the contract without giving a reason.
The service is digital content supplied immediately. By subscribing to a paid plan you expressly request performance to begin before the 14-day period expires and acknowledge that you thereby lose the right of withdrawal to the extent the service has been supplied. The right remains for any period not yet supplied.
To exercise the right of withdrawal, write to us at support@efakturi.net.
8. Availability
We aim for continuous availability but do not guarantee uninterrupted operation. Planned maintenance, incidents and third-party dependencies (hosting, email provider, payment processor) all occur. Unless a service level has been expressly agreed, the service is provided “as is”.
9. Liability
We are liable for damage we culpably cause, in accordance with Bulgarian law. Nothing here limits or excludes our liability for intent or gross negligence, for death or personal injury, or in any case where the law does not permit limitation.
Otherwise, and to the extent permitted by law, our liability for any event is limited to the amount you paid for the service in the preceding 12 months, or to EUR 50 on a free plan. We are not liable for lost profits, for penalties imposed on you by the tax authorities, or for data loss that your own exports would have prevented.
10. Intellectual property
The software, design, texts and the eFakturi.net brand are ours or lawfully used by us. You receive a non-exclusive, non-transferable right to use the service for its intended purpose for the term of the contract. Your data and documents remain yours.
11. Personal data
For your own account we act as data controller. For the data you enter about your clients we act as processor on your instructions. The details are in the Privacy Policy, which forms part of these Terms.
12. Termination
You may close your account at any time from settings. We may restrict or terminate access for a material breach of these Terms, for abuse, or where the law requires it - normally with prior notice, unless that is impossible or unreasonable.
After termination we give you a reasonable period to export your documents before the data is deleted.
13. Changes to these Terms
We may change these Terms. For material changes we will notify you by email or in the app at least 30 days in advance. Continuing to use the service after they take effect means you accept them; if you do not, you may terminate.
14. Governing law and disputes
Bulgarian law applies. If you are a consumer you keep the protection of the mandatory rules of your country of habitual residence and may bring proceedings before the courts of your domicile.
We try to resolve disputes amicably - write to us first. Consumers may also contact the Bulgarian Consumer Protection Commission (kzp.bg) or use the EU online dispute resolution platform at ec.europa.eu/consumers/odr.
If any provision of these Terms is found invalid, the remainder stays in force.
